Welcome to TokyoLume. These Terms of Service (the “Terms”) govern your access to and use of tokyolume.com and any related services, features, content, and purchases (collectively, the “Services”).

The terms “TokyoLume,” “we,” “us,” and “our” refer to the seller operating this store. The terms “you” and “your” refer to the customer, visitor, or other user of the Services.

These Terms should be read together with our Privacy Policy, Shipping & Delivery Policy, Returns, Refunds & Exchanges Policy, Payment Information, and Customs & Duties Guide. If a specific policy conflicts with these Terms on a subject covered by that policy, the specific policy will apply to that subject.

By creating an account, placing an order, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services or place an order.

Nothing in these Terms excludes or limits any mandatory consumer right or remedy available to you under applicable law.

1. Eligibility and accounts

You must have the legal capacity to enter into a binding contract in your place of residence, or use the Services with the permission and supervision of a parent or legal guardian.

You agree to provide accurate, current, and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Please contact us promptly if you believe your account has been used without authorization.

We may refuse, suspend, or close an account where reasonably necessary to address fraud, security risks, unlawful activity, or a material breach of these Terms.

2. Products and product information

TokyoLume offers curated goods sourced from official retailers or trusted wholesalers in Japan. All branded products sold by TokyoLume are authentic and are sourced from official retailers or trusted wholesalers in Japan. TokyoLume is an independent retailer and is not affiliated with, sponsored by, or endorsed by the relevant brand or rights holder.

We take reasonable care to describe and display products accurately. However:

  • Colors and appearance may vary slightly depending on your screen and device settings.

  • Measurements and weights are approximate unless expressly stated otherwise.

  • Minor manufacturing variations may occur.

  • Retail packaging may occasionally show minor cosmetic wear from handling or international transit.

These points do not affect your rights if an item is materially damaged, defective, unsafe, incorrect, or significantly different from its description. Further details are provided in our Returns, Refunds & Exchanges Policy.

Product availability can change without notice because many items are sourced from physical stores, official retailers, or suppliers in Japan. We may limit purchase quantities, discontinue products, or restrict sales to certain destinations where reasonably necessary.

3. Orders, availability, and contract formation

Submitting an order is an offer to purchase the selected products under these Terms. An automated order-confirmation email only acknowledges that we have received your order; it does not by itself mean that the order has been accepted.

Payment is normally authorized at checkout and captured only after availability has been confirmed. We accept your order when we confirm availability and capture payment. We may also send a separate processing or dispatch confirmation.

If an item is unavailable, we will contact you promptly. No final charge will be captured for an unavailable item. A temporary authorization may remain visible until your bank or payment provider releases it, and the timing of that release is controlled by the bank or payment provider.

Before an order is accepted, we may decline or cancel it for reasons including:

  • Product unavailability

  • An obvious pricing or product-information error

  • A payment authorization failure

  • Suspected fraud or unauthorized payment

  • Purchase-quantity limits

  • Legal, customs, carrier, or destination restrictions

If payment has already been captured for an order or item we cannot fulfill, we will issue a refund to the original payment method. Where only part of an order is unavailable, we will handle the order in accordance with our Shipping & Delivery Policy and contact you where appropriate.

You may request an order cancellation, address change, or order edit within 12 hours of purchase. We will accommodate the request where reasonably possible. Changes cannot be guaranteed after an order has entered processing or has been dispatched. Any mandatory cancellation or withdrawal right available under applicable law remains unaffected.

Unless we agree otherwise, products sold through the Services are intended for personal or household use. We may decline orders that reasonably appear to be for unauthorized commercial resale, fraudulent activity, or abuse of purchase limits.

4. Prices, currency, and payment

The product price charged will be the price shown at checkout when you submit the order, subject to the correction of an obvious error as permitted by applicable law.

Shipping charges and any taxes collected by us will be displayed at checkout before you submit the order. Unless expressly stated otherwise, product prices do not include import duties, destination-country VAT/GST, customs-clearance charges, or carrier handling fees payable upon import.

Prices, promotions, and discount codes may change or end without notice before an order is placed. Promotional terms may impose additional conditions. If promotional terms conflict with these Terms, the promotional terms will apply to that promotion.

If your payment account uses a different currency from the checkout currency, your bank or payment provider may apply its own exchange rate and fees. TokyoLume does not control those rates or fees.

You confirm that you are authorized to use the payment method submitted with your order and that the billing information you provide is accurate.

5. Shipping, delivery, and risk of loss

Orders are shipped from Japan using the methods described in our Shipping & Delivery Policy. Processing and transit times are estimates, not guaranteed delivery dates. Delivery may be affected by customs clearance, carrier operations, weather, public holidays, local conditions, or other events outside our reasonable control.

Risk of loss or damage is determined by the applicable law. Where mandatory consumer law requires it, including applicable consumer law in the European Union, European Economic Area, and United Kingdom, the goods remain at our risk until they are delivered to you or to a person you identify to receive them. If you independently appoint a carrier that we did not offer, risk passes when the goods are handed to that carrier.

A shipment recorded by the carrier as delivered to the address, designated recipient, parcel locker, or other delivery location authorized by you will generally be treated as delivered, subject to any mandatory rights under applicable law.

We are not responsible for delays, failed delivery, or returns caused by an incorrect or incomplete address, refusal of delivery, failure to collect the parcel, failure to pay applicable import charges, or failure to respond to customs authorities or the carrier. Additional shipping costs resulting from these circumstances may be charged to you where permitted by law.

Please report a parcel that is damaged, incorrect, incomplete, or shown as delivered but not received as soon as possible. Prompt notice helps us investigate and submit carrier claims. Any requested reporting period in our policies does not limit a mandatory legal right or remedy.

6. Customs, duties, and import requirements

Unless checkout or applicable law states otherwise, orders are shipped DAP (Delivered at Place). The recipient is responsible for import duties, destination-country VAT/GST, customs charges, carrier handling fees, and other import-related costs.

The recipient may be treated as the importer of record and may need to provide identification, proof of purchase, tax information, or other documents requested by customs or the carrier. Customs rules, thresholds, and rates vary by destination and may change without notice.

TokyoLume does not control customs decisions or clearance times. Taxes and duties paid directly to customs authorities or carriers are generally not refundable by TokyoLume. More information is available in our Customs & Duties Guide.

7. Returns, refunds, and exchanges

Returns, refunds, exchanges, damaged-item claims, and change-of-mind requests are governed by our Returns, Refunds & Exchanges Policy, which forms part of these Terms.

Our voluntary return policy does not replace or reduce any mandatory consumer rights, including any applicable rights relating to faulty, damaged, unsafe, incorrect, or misdescribed goods and any statutory right of withdrawal.

8. Parallel imports and manufacturer support

Some products may be sold as parallel imports in the destination country. Manufacturer warranties, repairs, replacement programs, or after-sales support outside Japan may therefore be unavailable or restricted.

This does not exclude or limit any mandatory right or remedy you may have against TokyoLume under applicable consumer law.

9. Safe and lawful product use

You are responsible for reading and following product labels, warnings, age recommendations, care instructions, and usage directions supplied with a product. Products must not be used in an unsafe, unlawful, or unintended manner.

If a product appears damaged, unsafe, or subject to a safety notice or recall, stop using it and contact us. Nothing in this section limits liability or remedies that cannot lawfully be excluded.

10. Intellectual property and brand ownership

The TokyoLume name, logo, original text, original graphics, site design, and other content created by or for TokyoLume are protected by applicable intellectual-property laws. You may use the Services for personal, non-commercial shopping purposes but may not copy, reproduce, distribute, modify, republish, or commercially exploit protected TokyoLume content without prior permission, except where permitted by law.

Third-party trademarks, character names, product images, logos, and designs remain the property of their respective owners. Their appearance on the Services does not imply affiliation with or endorsement of TokyoLume.

11. Reviews, feedback, and user content

If you submit a product review, photo, comment, suggestion, or other content to TokyoLume, you confirm that you have the right to submit it and that it is accurate, lawful, and does not infringe another person’s rights.

You grant TokyoLume a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt for formatting, and use that content in connection with operating, improving, and promoting the Services. This license continues for as long as reasonably necessary for those purposes, subject to applicable privacy and consumer law.

You must not submit content that is fraudulent, misleading, defamatory, abusive, obscene, infringing, malicious, or unlawful. We may moderate or remove user content where reasonably necessary, but we are not required to publish or retain every submission.

12. Prohibited uses

You must not use the Services to:

  • Violate any applicable law or another person’s rights

  • Commit or facilitate fraud, payment abuse, or identity misrepresentation

  • Transmit malware or harmful code

  • Interfere with the security, availability, or operation of the Services

  • Obtain unauthorized access to an account, system, or data

  • Collect personal information about others without lawful authority

  • Send spam or other unauthorized communications

  • Use automated scraping, crawling, or purchasing tools in a way that burdens, disrupts, or circumvents the Services or purchase limits

  • Copy or exploit the Services or protected content for unauthorized commercial purposes

We may restrict or suspend access where reasonably necessary to protect customers, TokyoLume, Shopify, service providers, or the integrity of the Services.

13. Third-party services, links, and Shopify

The Services may include payment providers, carriers, tracking tools, social-media features, apps, or links operated by third parties. Their services may be subject to separate terms and privacy policies. TokyoLume is not responsible for third-party websites or services that we do not control, except to the extent responsibility cannot lawfully be excluded.

Our store is hosted on Shopify. Shopify provides the e-commerce platform, but products purchased from this store are sold by TokyoLume, not Shopify. Questions, claims, returns, and order issues relating to a purchase should be directed to TokyoLume.

14. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy. Because the Services are hosted by Shopify and use third-party providers, personal information may also be processed by Shopify and other providers as explained in that policy.

15. Website availability, errors, and changes

We aim to keep the Services accurate, secure, and available, but we do not guarantee that the website will always be uninterrupted or error-free. We may update, suspend, or discontinue website features where reasonably necessary.

We may correct typographical errors, inaccurate descriptions, availability information, shipping charges, or pricing information. If a correction materially affects an order you have already placed, we will contact you and provide any option or remedy required by applicable law.

16. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, intentional misconduct or gross negligence, death or personal injury caused by negligence, or breach of a mandatory consumer right.

If you use the Services as a consumer, we are responsible for loss or damage that is a reasonably foreseeable result of our breach of these Terms or our failure to use reasonable care. We are not responsible for loss or damage that was not reasonably foreseeable when the contract was formed.

TokyoLume supplies products for personal and household use unless otherwise agreed. If you use a product or the Services for a commercial or business purpose, we are not responsible, to the extent permitted by law, for loss of profit, loss of revenue, loss of business, loss of opportunity, or other indirect or consequential business loss.

We are not responsible for delays or failures caused solely by events outside our reasonable control, provided that we take reasonable steps to reduce the effect of the event and perform any obligations required by applicable law.

17. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access to an account or website feature where reasonably necessary because of a material breach of these Terms, fraud, unlawful activity, security risk, or misuse of the Services.

Suspension or termination does not affect rights and obligations arising from an accepted order, amounts already due, or provisions that by their nature should continue, including intellectual-property, liability, dispute, and governing-law provisions.

18. Changes to these Terms

We may update these Terms to reflect changes in the Services, our business practices, or legal and regulatory requirements. The updated version will be posted on this page with a revised “Last updated” date. Where required by law, we will provide additional notice of material changes.

Changes apply prospectively. An order is generally governed by the Terms in effect when the order was placed unless applicable law requires otherwise or you agree to a later change.

19. Governing law and disputes

These Terms and contracts formed through the Services are governed by the laws of Japan, without regard to conflict-of-law principles.

This choice of law does not deprive a consumer of any mandatory protection available under the law of the country or region in which the consumer habitually resides where that protection applies.

If a dispute arises, please contact us first so that we can try to resolve it in good faith. To the extent permitted by applicable law, the courts having jurisdiction over Osaka, Japan will have non-exclusive jurisdiction. Nothing in this section prevents a consumer from using a court, regulator, alternative-dispute process, or other forum available under mandatory law.

20. General provisions

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision on one occasion is not a waiver of our right to enforce it later.

You may not transfer your rights or obligations under these Terms without our consent. We may transfer our rights and obligations as part of a sale, transfer, or reorganization of the business, provided that doing so does not reduce your mandatory rights.

These Terms and the policies incorporated into them form the agreement between you and TokyoLume concerning the Services and purchases from the store. Headings are included only for convenience.
